Our Agreement

Although we tried to avoid it, our lawyers told us there was no way we could be in business without setting out the terms of this agreement. This agreement is a legal document which sets out your rights and obligations, and those of Divine Audio, in relation to the fantastic services offered by us through this site or any of the other Divine Audio sites to which we link.

Delivery Timescales

Delivery in the UK is free for all items.

Delivery for International orders under 2 Kg will cost the following

Any item over 2 Kg in weight is shipped via our International courier DPD and is priced according to the weight of the item and where it is being shipped. Delivery costs are displayed at the checkout process.

We always aim to ship all orders received before 3 PM the same working day. Standard Delivery takes approximately 2-3 days, but is not guaranteed.

If you have any special delivery requirements, please contact us and we'll do our best to facilitate your needs.

Price Promise

At Divine Audio we strive to be the best price on the web, however if you do see an item cheaper elsewhere please email us where you found the item cheaper and email us the link to sales@divineaudio.co.uk or call us on +44(0)1536 765531 and we'll do our best to beat the price.

Cancellation Policy

You are entitled to cancel this contract if you wish provided you exercise your right no longer than two working days after the day on which you receive your order. If you wish to exercise your right to cancel this contract prior to order despatch, please contact sales@divineaudio.co.uk. If your order has already been despatched please follow the procedure set out in the Returns & Refunds Policy below.

Returns & Refunds Policy

If you wish to return items for a refund, first contact us via e-mail at sales@divineaudio.co.uk within two days of receipt. Then return the items in their original condition to the returns address below. We will refund the value of the returned items less delivery costs, providing the items are undamaged and in their original packaging. Returned items must be received within 7 days. Always retain your proof of posting. Divine Audio will not be held responsible for items damaged or lost while being returned to the company.

Effect of this agreement

Viewing of the Divine Audio site itself is free; but when you purchase from the site, you agree to the terms of this agreement, and you re-affirm that agreement every time you use Divine Audio services, so we recommend you read this agreement so you know what you're getting yourself into.

Applicable law

Divine Audio Ltd is a company registered in England, and every sale shall be deemed to be performed in England; English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Making a contract with us

In return for the excellent service we will give you, we ask that you agree to purchase from Divine Audio using your correct name and address. You may be asked to enter credit, debit or charge card details. You must ensure that (a) you are fully entitled to use that card at the time when you provide those details to Divine Audio, and when you use the card, and b) the card has available funds to cover all charges incurred on it in the course of buying from us. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information immediately.
In any event, to register for Divine Audio services, you must legally be able to enter into contracts for goods and services that you may buy here. Generally, this means that you must be at least 18 years old and sane.

Tax & Duties

We will reluctantly have to charge VAT on all goods and services where applicable. And if you want your purchase to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties. Sorry!

Corrections

You may think we are just making this stuff up but in fact, descriptions of goods and services included in the Divine Audio site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them.

Copyright

We took a long time playing with our crayons and thinking about them, so you accept that the images and designs used on the Divine Audio website are the property of Divine Audio or their respective copyright owners, and are used by Divine Audio pursuant to express authorisation from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to Divine Audio are vested in Divine Audio or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. Not only will this make us throw our toys around, but in the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts. And that won't be pretty.

Loss

Our lawyer told us we had to put this in, so please be aware that we will not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused. You also agree that the liability of Divine Audio under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you.
This does not affect your statutory rights as a consumer.

Consequential Loss

In the event of consequential loss, Divine Audio can only be responsible for the cost of your order.

Negligence

Although we couldn't think of any way this could possibly happen, we thought we should state that nothing in this agreement limits Divine Audio’ liability for personal injury or death resulting from our negligence.

Reasonable Control

Divine Audio shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control. Without limiting ourselves here in any way, we were thinking of a hand of God, or alien invasion.

Changes to this Agreement

Due to the fact that some clever clogs is always coming up with new rules and regulations, Divine Audio reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.

Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Divine Audio is a trading name of Divine Audio Ltd. We are registered in England; Company number 5162790; at Fountain Court, High Street, Market Harborough, LE16 7AF.

Security and Privacy

We know you're concerned about security and privacy. We want to reassure you that any information you give us during the ordering process as well as any that we know about you by other means will be well protected. We also feel it is important that you know exactly how any information you give us is used and that all information is collected lawfully and in accordance with the Data Protection Act 1998.

How we use your data

The privacy policy forms part of the agreement between us, and by purchasing goods from our site, you agree to be bound by the terms and conditions of the agreement between us. You also give your consent to the way we may handle your personal data in the way stated in this policy statement. Divine Audio will not use this data, or disclose it to any other party, without your express permission.

We may also contact you in respect of special offers or competitions, but only if you have elected to receive this by checking the opt-in box during the purchase procedure. You may unsubscribe from our contact list at any time by replying to a promotional email with the word “unsubscribe” in the subject line or by e-mailing us at chris@divineaudio.co.uk. To provide a service that meets our customer needs, we may collect personal data relating to the popularity and usage of particular aspects of the site or related Divine Audio sites. However this data will be used or aggregated only on an anonymous basis.
